In a serious reduction to civilian incapacity pensioners, the federal government has clarified that pre-2006 disabled personnel shall even be entitled to obtain the “service element” of incapacity pension regardless of the size of service.

This would considerably improve their pension and they might even be paid arrears for the previous about 14 years.

This will profit 1000’s of incapacity pensioners of the assorted Central Armed Police Forces in addition to organisations resembling Coast Guard, General Reserve Engineering Force and Railways.

Disability pension consists of two components — the service expertise, which pertains to the size of service rendered and the incapacity component, which is related to the quantum of incapacity.

Prior to 2006, the incapacity pensioners receiving pension underneath the Central Civil Services Extraordinary Pension Rules required 10 years of qualifying service to earn the service component.

In 2010, on the strains of the defence companies, the minimal qualifying service for service component of incapacity pension was abrogated with retrospective impact from 2006. However, the disabled retirees who have been launched from service previous to 2006 weren’t paid the service component attributable to a gray space within the coverage.

In 2019, a disabled retiree from the Coast Guard, Rajesh Dahiya, approached the Punjab and Haryana High Court towards denial of service component to him and he sought instructions to the Department of Pension and Pensioners’ Welfare (DoPPW) from the Court for a choice on his detailed representations to the division to make clear the problem on launch of service component to pre-2006 circumstances.

The bench of Justice Harsimran Singh Sethi had then directed DoPPW to take a remaining resolution within the matter inside a interval of three months. The division had later knowledgeable the petitioner that it was trying into the matter and wanted some extra time.

The DoPPW has now issued orders to all ministries and has directed the discharge of service component to pre-2006 incapacity pensioners with lower than 10 years of service with monetary impact and arrears from January 1, 2006.

Experts say that this may come as a boon to many CAPF personnel who have been paid a meagre incapacity component which was not adequate to cater to even fundamental wants.

An officer effectively versed with the topic added that the minimal month-to-month incapacity pension at present charges admissible to affected retirees would now be Rs 18,000 monthly.
