AGR Case: SC asks Centre to spell out stand on Reliance Jio sharing RComm spectrum

The Supreme Court on Monday requested the Centre to spell out its stand on Reliance Jio sharing RComm spectrum because it explored methods and means to make telecom corporations clear their dues on account of the AGR.

A Bench led by Justice Arun Mishra mentioned it wished to know if Reliance Jio could be requested to discharge RComm dues as Jio is incomes income from the shared spectrum. 

Solicitor General Tushar Mehta mentioned the federal government would assist any choice that the court docket took to assist the restoration of AGR dues. 

Awaiting the federal government reply, the Bench posted the matter for additional listening to on August 19.

Earlier within the day, it dismissed a PIL searching for a route to authorities to make instant preparations for the restoration of AGR dues from telecom corporations.

“Why do you want to complicate the issue? Do not misuse Article 32 like this,” a Bench led by Justice Arun Mishra informed petitioner Anshul Gupta.

“We are already hearing the matter. Not inclined to entertain this,” mentioned the Bench dismissing the PIL.

In an affidavit filed within the court docket, Reliance Jio mentioned spectrum sharing with RComm did not fasten legal responsibility for previous dues.

The DoT did not elevate any claims in opposition to Reliance Jio, which was not a celebration to AGR case, it mentioned, including RCom had already submitted financial institution assure in the direction of the dues.

Spectrum Sharing Guidelines did not make any provision for sharing of liabilities, it submitted.
